Terms of Service

These terms govern your use of Heranode ("the service"), operated by Heranode ("we", "us"). By creating an account or using the service, you agree to them. If you are using Heranode on behalf of an organization, you agree on its behalf and confirm you have the authority to do so.
01The service
Heranode is a distributed uptime monitoring platform. It performs scheduled HTTP checks against endpoints you configure, from multiple geographic probe locations, and provides response-time analytics, incident tracking, alerting, and public status pages based on the results.
02Your account
You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account and for the actions of team members you invite. Notify us promptly at hello@heranode.com if you suspect unauthorized access.
03Acceptable use
You may only monitor endpoints you own or are explicitly authorized to monitor. Configuring checks against third-party systems without permission is prohibited, even at low frequencies. We may suspend monitors that generate abuse complaints from endpoint operators.
In addition, you must not use the service to:
- perform load testing, stress testing, or any activity intended to degrade a target system — probes are for availability checks, not traffic generation;
- scrape content, enumerate endpoints, or circumvent rate limits, authentication, or other access controls on any system;
- monitor endpoints serving unlawful content, or use the service in violation of applicable law;
- probe, disrupt, or reverse engineer the service itself, or resell access to it without our written consent.
We may suspend or remove monitors, or suspend accounts, that violate this section. Where practical, we will notify you first.
04Plans and limits
Each plan tier defines limits on the number of monitors, minimum check intervals, probe locations, data retention, and included features, as described on our pricing page. We may enforce these limits technically, and we may apply fair-use throttling to protect the platform. We can change plan features with reasonable notice; changes that materially reduce a paid plan take effect at your next renewal.
05Billing
Paid plans are billed in advance on a recurring subscription basis and renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable. We may change prices with at least 30 days' notice before your next renewal.
06Availability and disclaimer
The service is provided "as is" and "as available". Monitoring is performed on a best-effort basis: we do not guarantee that every incident on your infrastructure will be detected, that every alert will be delivered, or that the service itself will be uninterrupted. Heranode is a monitoring layer, not a substitute for your own operational practices, backups, or incident response.
07Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data — including losses arising from undetected outages or undelivered alerts. Our total aggregate liability arising out of the service is limited to the fees you paid us in the 12 months preceding the claim, or 50 EUR if you use a free plan.
08Suspension and termination
You may stop using the service and delete your account at any time. We may suspend or terminate accounts that violate these terms, create security risk, or fail to pay applicable fees. After termination, your configuration and telemetry are deleted in accordance with our Privacy Policy; export any data you need before closing your account.
09Changes to these terms
We may revise these terms as the service evolves. Material changes will be announced by email to account owners at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
10Governing law
These terms are governed by the laws of [Jurisdiction], excluding its conflict-of-law rules. Disputes arising from these terms are subject to the exclusive jurisdiction of the courts of [Jurisdiction].
